This User Agreement (‘Agreement’) governs the use of the web site located at http://www.sessioneer.org ('Site'), produced by Michael Simpson ('Sessioneer') including participation in all site functions (the 'Service'), by You (the 'User'). Your right to use the Service is limited to personal and non-commercial use. You may only be an individual, i.e., You may not be a corporation or other business entity. The Service is made available under the terms and conditions of this User Agreement and any rules or policies published by Sessioneer on the http://www.sessioneer.org website. This Agreement constitutes the entire agreement between You and Sessioneer. By logging into the Site using the password provided during the registration process you explicitly indicate your acceptance to be bound by the terms of this Agreement. Your acceptance of this Agreement is not affected if You change Your password.

Any of the terms of this Agreement and the conditions and rules applicable to use of the Site may be changed, added to or deleted at any time by Sessioneer, at its sole and absolute discretion. Such changes, additions or deletions will be posted on this page and will be effective immediately upon posting. Continued use of the Service after such time shall be deemed to constitute acceptance of such changes, additions or deletions. It is the responsibility of the User to regularly review the terms of this Agreement.

A User shall not post, provide or otherwise make available any material of any sort that:

1. Is defamatory or libellous or would violate or infringe in any way upon the rights of others,
2. Is protected by copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy, without the express permission of the owner of such rights
3. Violates any applicable local, national, international or foreign law, statute, ordinance or regulation including without limitation the laws and regulations governing export control, or would give rise to criminal or civil liability of any sort whatsoever
4. Is illegal or promotes illegal activity
5. Is pornographic, obscene, objectionable or offensive
6. Promotes bigotry, racism or hatred
7. Is threatening or abusive or promotes physical harm or violence against any individual or group
8. Violates any laws regarding unfair competition, anti-discrimination or false advertising
9. Contains any viruses, Trojan horses, time bombs, worms, cancelbots or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information
10. Impersonates without limitation any Sessioneer personnel
11. Impersonates any living person or copyright fictional character or any person deceased for a period of not less than five years.

Sessioneer reserves the right to establish and modify the criteria for what constitutes offensive or objectionable material. It is impossible for Sessioneer to know whether a posting constitutes a copyright or other infringement. The provider of such content is responsible for ensuring that such content does not violate the intellectual property rights of another. Sessioneer does not maintain a policy of monitoring material provided by Users for compliance with these Terms of Use. However, Sessioneer reserves the right at any time to remove any material provided by a User in its absolute discretion. Exercise of this right by Sessioneer shall in no way imply that Sessioneer condones or approves of or takes any responsibility for any material provided by Users which remains on the Service.

Copyright

Each User grants to Sessioneer a perpetual, irrevocable, royalty-free, non-exclusive, sublicenseable (through multiple tiers) right and license to use, reproduce, sell, modify, adapt, publish, translate, create derivative works from, distribute, perform, play, and exercise all copyright and publicity rights with respect to any content such User provides to the Service worldwide and/or to incorporate it in other works in any form, media or technology now known or later developed for the full term of any rights that may exist in such content, consistent with privacy restrictions set forth in this Agreement. In addition, no User may seek to restrict Sessioneer’s rights to such content through the use of any statement or legend. If the User does not wish to grant such rights to Sessioneer, it is suggested that You do not provide such content to the Service. Other than materials You may author and post, material may not be excerpted or copied for any purpose without the prior express written permission of Sessioneer.

Privacy policy

Sessioneer shall not pass on any personal information that You may provide us with for commercial gain, unless You explicitly permit Sessioneer to do so during the registration process or by modifying Your personal preferences information on the Site.

Sessioneer will take reasonable measures not to disclose information about You or the contents of Your communications except that Sessioneer may do so in the good faith belief that such action is reasonably necessary

1. to comply with the law;
2. to comply with legal process;
3. to enforce these terms and conditions;
4. to respond to claims that any content violates the rights of third parties; or
5. to protect the interests of Sessioneer or others.

Breach of Terms

Sessioneer reserves the right to record the User ID, date and time, and IP address of the posting computer, for all information that You post to the Site. The above information may only be used to verify Your identity, and only if it appears that You have posted material that breaches the terms of this Agreement.

If You post material that breaches the terms of this Agreement your post will be deleted immediately and your account suspended indefinitely.

Sessioneer retains the right to determine in its absolute discretion what material shall constitute a breach of these terms and to take action accordingly.
